The Firm has considerable experience in handling complex commercial litigation on behalf of companies and individuals on both sides of the docket in a variety of settings. Plaintiff Our last two suits, both which were covered extensively in the Wall Street Journal, were successfully resolved prior to trial. The first suit was filed in Miller County, Arkansas against the major accounting firms. This class action suit, with an Arkansas-based shopping center owner acting as class representative, accused the firms of overcharging its clients for travel expenses and resulted in a $108 million dollar settlement. The second suit was filed in federal court in Texarkana, Texas on behalf of Sendo Holdings, PLC (a cell phone manufacturer based in England). This suit alleged, among other things, that Microsoft had misappropriated its trade secrets. This suit resulted in a confidential settlement. We are currently working on class actions involving natural gas rates and several involving defective products. In addition, we have initiated litigation on behalf of such companies as:
• Novation, LLC and VHA, Inc. (insurance) • Union Pacific Railroad Company (insurance) • Arescom (breach of contract) In addition to representing some of the largest financial institutions, corporations and health care facilities in the area, we have served (or are serving) as co-counsel for numerous national and international companies, including several in the Fortune 500. In this regard, we have defended such companies as:
• Baskin-Robbins (litigation against companies by franchisees) • Brown & Williamson (suit by State of Texas for reimbursement of tobacco-related health care costs) • Century Bank (lender liability) • Ditch Witch Corporation (product liability) • Munters Corporation (antitrust) • Nestle Waters including Perrier and Ozarka (environmental) • Novation, LLC and VHA, Inc.
